Houston parks receive some TLC

Galveston bankruptcy lawyers of Gipson, Norman, and Root are thrilled announce that volunteers across Houston gathered over the weekend to plant trees in Houston parks.

Houston parks have been hit hard by the drought, and the Houston Parks Department called on volunteers to plant trees in Memorial, Mason, Hermann and MacGregor Parks.

The I-10 freeway has become exposed now that many tree have died, and it is now more common to see men with hard hats and saws ready to clear out the dead trees than lush foliage.  ”Here we’ll be planting approximately 20,000 trees. We won’t cover the freeway up tomorrow, but our goal is, down the road, we will have the freeway covered back up,” said Joe Turner, Houston Parks and Recreation director.

High-end residence for the elderly files for bankruptcy

A high-end residency for the elderly called The Clare at Water Tower in Chicago filed for Chapter 11 bankruptcy from creditors.

The not-for-profit facility filed at the U.S. Bankruptcy Court in Chicago listing $100 million to $500 million in assets and liabilities.  Its creditors include the Franciscan Sisters of Chicago Service Corp., Loyola University, the City of Chicago, and Greystone Development of Irving, TX.

The Clare at Water Tower is waiting on court approval to borrow $12 million from Redwood Capital Management LLC during the bankruptcy.

Blockbuster tries to break 187 leases

According to recent court filings, Blockbuster is trying to break 187 leases of stores that are located in 30 states.

The states include, California, North Carolina, Texas, Minnesota, Georgia, and Illinois. The movie-rental chain, Blockbuster Inc., is based in Dallas, Texas and filed for bankruptcy in September and announced a few months later that 187 stores would be closed.

Under the reorganization process of bankruptcy, unless a written objection is to filed, the leases will be rejected. An auction held by Blockbuster is set for April 4.

Seahawk Drilling files for bankruptcy in Corpus Christi

Earlier this month, Seahawk Drilling Inc. filed for Chapter 11 bankruptcy protection in the U.S. Bankruptcy Court in Corpus Christi.  The drilling service company plans to sell its assets to an offshore drilling company, Hercules Offshore Inc.

“It is imperative to commence the process approving the sale to Hercules, which the debtors’ believe will result in the highest value for the debtors’ assets.  Because of the lack of capital, continued operation of the debtors’ business without a sale of the purchased assets is not an option,” stated Seahawk Drilling CEO Randall Stilley.

In the bankruptcy filing, Seahawk listed between $500 million and $1 billion in both assets and liabilities.

Borders files for Chapter 11 bankruptcy

Today, Borders Group Inc. filed for Chapter 11 bankruptcy and announced that they will be closing at least 200 bookstores across the country, or about 30 percent of the company’s stores.  Borders Group owns both Borders and Waldenbooks stores.

Chapter 11 bankruptcy will allow the bookseller to reorganize the business and pay off any creditors while still keeping some stores open and operating.  Borders noted that they will keep all of their customer programs the same including gift cards and the Borders rewards program.

Borders Group Inc. President Mike Edwards stated, “It has become increasingly clear that in the light of the environment of curtailed customer spending…and the company’s lack of liquidity, Borders Group does not have the capital resources it needs to be a viable competitor.”

Loehmann’s files for Chapter 11 bankruptcy

Early today, discount retailer Loehmann’s filed for Chapter 11 bankruptcy protection.  The bankruptcy filing listed both their assets and debts ranging between $100 and $500 million.

According to sources, Loehmann’s executives decided to file for Chapter 11 bankruptcy after debt negotiations with a major lender fell through.  Chapter 11 bankruptcy will allow Loehmann’s stores to continue operating while the business is reorganized and lenders are repaid.

The filing stated that the company hopes to exit bankruptcy within the first quarter of 2011.  In addition, reorganization plans include placing 51 percent of ownership in the hands of its secured lenders and 49 percent with its current owner, Istithmar World.

Emivest Aerospace Corp. files for Chapter 11 protection

On October 20, San Antonio-based Emivest Aerospace Corp. filed for Chapter 11 bankruptcy protection in the U.S. Bankruptcy Court in Delaware.  Emivest manufactures corporate jets in Texas and West Virginia.  A spokesperson for Emivest, Mark Fairchild, reported that Emivest will continue operations both in San Antonio and at their site at Eastern West Virginia Regional Airport.  Chapter 11 bankruptcy allows businesses to continue operating while they work to pay off their debts and restructure the company.

The bankruptcy filing states an estimated number of creditors between 200 and 999.  In addition, both assets and liabilities were listed as being between $50 million and $100 million.

‘Hour of Power’ church files for bankruptcy

The 10,000 member California megachurch famous for creating the televangelist show “Hour of Power”, Crystal Cathedral, filed for Chapter 11 bankruptcy on Monday after creditors began suing it for payments.  Chapter 11 bankruptcy allows a business to continue operating while they restructure and pay off debts.

According to court documents, the church has assets between $50 million and $100 million and a budget deficit of $55 million.  Over the past two years the church has seen a 27% drop in revenues.  In addition to a $36 million mortgage on its 40 acre lot, Crystal Cathedral owes $7.5 million to hundreds of vendors.

Church officials say that “Hour of Power”, which attracts an estimated audience of between 800,000 and 1 million people, Sunday services and the Crystal Cathedral Academy and High School will continue to operate as usual.

Blockbuster files for Chapter 11

Last week, Blockbuster Inc. officially filed for Chapter 11 bankruptcy protection after months of planning the filing.  Under Chapter 11, Blockbuster is able to continue operating its remaining 3,000 stores and online and kiosk rentals while they restructure the company and pay off debts.  The bankruptcy filing does not affect their international stores or business.

In the filing, Blockbuster listed $1.46 billion in debt and almost $1 billion in assets.  Blockbuster hopes to reduce its debt to around $100 million by transferring debt to equity.  Note holders agreed to pay $125 million in debtor-in-possession funds for the company to pay off its employees, suppliers and customers.

In order to become competitive against companies like Netflix and RedBox, Blockbuster plans to develop their online and kiosk rental services.

Blockbuster to declare bankruptcy mid-September

Blockbuster CEO, Jim Keyes, told movie studios this week that he expects the company to file for Chapter 11 bankruptcy by mid-September.  Chapter 11 bankruptcy allows a business to restructure and pay off debts while continuing operations.

Keyes says he expects to close between 500 and 800 stores to help pay off nearly $1 billion in debt.  Blockbuster started to accumulate debt after the digital distributor Netflix and kiosk distributor RedBox began to grow in popularity a few years ago.  Last year, 1,000 Blockbuster stores had to be closed due to slowed sales.

Keyes told studios and creditors that he hopes the company will be out of bankruptcy within five months, after which, he plans to expand Blockbuster into the digital and kiosk distribution markets.
