Houston Texans kickoff their first playoff game in history

Wade Phillips, defensive coordinator for the Texans, is considered to be the biggest asset to the Texans’ game.  Phillips, who was formerly the Dallas Cowboys head coach, has completely changed the Texans’ defense by bringing in some key players such as cornerback Jonathan Joseph and linebacker Brian Cushing.

South-Central Texas bankruptcy filings experience year-over-year increase

Last month, bankruptcy filings filed in South-Central Texas experienced a 10 percent year-over-year increase.

The data was reported by the U.S. Bankruptcy Court for the Western District of Texas in San Antonio.  Experts say the increase reflects the growth in personal bankruptcy filings.

439 bankruptcies were filed at the court in October.  Last year in October, 398 bankruptcies were filed at the court.

Chapter 13 bankruptcy filings filed last month increased by 13 percent compared to last year.  A total of 269 Chapter 13 bankruptcies were filed at the court in October 2011.  Chapter 7 filings increased by 9 percent from 149 in October 2010 to 162 last month.

Ch. 13 filings up by 8 percent in 2010

In 2010, total chapter 13 bankruptcy filings increased by 8 percent from 2009.  Last year, a total of 438,913  chapter 13 petitions were filed in the United States.  In 2009, only 407,000 cases of chapter 13 were filed.

According to the U.S. Court System, chapter 13 filings were only topped by chapter 7 bankruptcy filings.  In 2010, 1.1 million chapter 7 petitions were filed across the country.

Chapter 13 bankruptcy allows individuals a chance to restructure their finances under the supervision of a federal bankruptcy court.  Also, individuals may be able to avoid home foreclosure with this option for bankruptcy protection.

Supreme court rules against deduction for car owners

Supreme Court Justice Elena Kagan, the court’s newest member, gave her first court opinion yesterday when the Supreme Court ruled that people filing for Chapter 13 bankruptcy are not eligible for a car ownership deduction unless they are still making monthly payments toward the vehicle.

The case involved a man who outright owned his Toyota Camry, however still tried to claim a car ownership deduction.  When calculating disposable income, the court ruled that only monthly payments that are applicable, meaning still being incurred, are eligible for deduction.  For this reason, the man, who was no longer making any loan or lease payments on the vehicle, is not eligible for a deduction.

Justice Department intensifies Chapter 13 reviews

Officials from the U.S. Justice Department Trustee Program announced last month that they will be enforcing more meticulous inspections of foreclosure documents and Chapter 13 bankruptcy filings after they noticed an increase in documentation errors made by banks.  The most common errors found include inflating fees and lenders failing to continue foreclosure actions against borrowers.

Although chapter 13 bankruptcys allow consumers to keep their house and extend their mortgage, while the filing is being reviewed individuals are required to continue to meet mortgage payments.  Many executives in the banking industry have acknowledged that paperwork mistakes and documentation errors can happen easily.  Homeowners are concerned about these errors as it could make them lose their chance of reworking a mortgage and keeping their home.

Personal bankruptcy filings increase 2.6% in Sept.

Last month, 130,329 personal bankruptcies were filed in the United States.  September’s total is a 2.6 percent increase from total personal bankruptcy filings in August.

According to the American Bankruptcy Institute, the total number of bankruptcies filed this year reaches nearly 1.2 million- an 11.3 percent increase from this time last year.  Experts estimate there will be a total of 1.6 million bankruptcies filed by the end of the year.  In 2009, 1.4 million bankruptcies were filed.

Executive Director of the institute Samuel J. Gerdano stated, “Families are very vulnerable…We expect, certainly through the balance of this year that bankruptcy will continue to be viewed as a possible solution for people who are having trouble meeting their obligations month to month”.

This year’s filings are the highest since 2005 when the bankruptcy system was made over to make it more difficult for people to escape their debts.

Bankruptcy Battle Between NHL, Moyes Rages On

Another in a series of lawsuits has been filed by the National Hockey League against former Coyotes owner Jerry Moyes.

 

The NHL filed a breach of contract lawsuit against Moyes in New York City District Court Friday. The newest lawsuit claims Moyes violated a 2006 contract stating he would not explore any sale that would move the Coyotes out of Phoenix.

 

The NHL has been locked in litigation against Moyes since he put the team in bankruptcy last year and attempted to sell the franchise to Canadian businessman Jim Balsillie. The legal battle sparked by the bankruptcy filing was thought to be over in November when Balsillie was rejected as an owner and the league gained control of the team.

 

Moyes lawyer says the most recent lawsuit has "no basis in law."

Air America Files for Chapter 7

Air America Media has filed for bankruptcy to liquidate after a drop in advertising sales.

 

The liberal-leaning radio station filed the Chapter 7 petition in United States Bankruptcy Court in Manhattan earlier this month. Listing assets of $1.5 million and debt of $17.2 million, the company said it was forced to cease operations in January after an industrywide drop in advertising sales.

 

Citadel Broadcasting Corp., the stations owner, filed for bankruptcy protection in December.

 

Air America launched in 2004 but could not overcome the industry's recent drop in ad revenue. The company showed losses over the past ten quarters and fell twenty-nine percent in 2009.

Will filing for bankruptcy ruin your credit score?

When people consider filing for bankruptcy, they worry that this filing will ruin their credit score and make it difficult to secure future loans. While this is true in certain circumstances, bankruptcy can also benefit a person's credit score in the long term. 

By filing for bankruptcy, a person's credit score will likely drop. However, by securing a number of short-term loans and repaying them appropriately, a formerly bankrupt person can rebuild its credit score. 

Ultimately, if you are so indebted that creditors will no longer lend to you, bankruptcy may be the only option, and your opportunity for improving your credit score will not be completely impaired by filing.
